Herbert Louis Ashby was born on August 13, 1929, in Jersey City, New Jersey. He served as an Associate Justice in Division 5 from June 28, 1972, to August 31, 1992.

In terms of education, Ashby completed his Bachelor of Arts degree at the University of New Mexico in 1952. He then went on to earn his LL.B. from the University of San Francisco School of Law in 1958. During his time at law school, he was recognized on the Dean's Honor Roll and received the Natham Burkam Award for Copyright Law. He was admitted to the State Bar on January 7, 1959, and also joined the New Mexico Bar in the same year.

Ashby has a rich judicial experience. He served as a Private Judge at the Alternative Resolution Center from 1992 onwards. Before that, he was an Associate Justice at the Court of Appeal, 2nd Appellate District, Division 5 from June 28, 1972, to August 31, 1992. He was appointed to this position by Governor Ronald Reagan.

Before his judicial appointments, Ashby had a diverse professional background. He served as the Chief Assistant Attorney General at the Department of Justice in Sacramento, California from 1971 to 1972. Prior to that, he was the Assistant Secretary at the California Human Relations Agency from 1970 to 1971. He also worked as a County Counsel from 1966 to 1970.

Earlier in his career, Ashby served as an Assistant District Attorney in Ventura, California from 1962 to 1966, and as a Deputy District Attorney in the same location from 1961 to 1962. In 1960, he was in private practice with the firm Scott, Scott & Ashby in Salinas, Monterey County. He started his legal career as a Law Clerk for Chief Justice James B. McGhee of the New Mexico Supreme Court in 1959.

In addition to his legal career, Ashby also served in the U.S. Army from 1953 to 1955.
